Skilled Independent Visa (Subclass 189)

Australian Skilled Independent Visa (Subclass 189) was brought into being to cater to the skill shortages of Australia. It is a Permanent Visa and falls under the Australian Immigration points-based system. Applicants must furnish that they possess the qualification or the skills of an occupation in the Skilled Occupation List (SOL). Applicants do not need sponsorship from family or the Australian State/ Territory Government nomination. Skilled Independent Visa (Subclass 189) applicants are required to obtain a minimum of 65 points on a point assessment.

Requirements:

In order to qualify for a Skilled Visa, the applicant (or their partner) must be able to satisfy the basic visa requirements related to Age, English language ability, Specific Work Experience, Skills, Qualification, Health and Character. Based on these credentials, the applicant has to score a minimum of 65 Points in order to qualify.

 

Features of this Program:

This Category permits the applicant an indefinite stay in Australia.

Permanent residents under the Australian Skilled Immigration Program have full access to health care benefits and certain social security payments.

Permanent residents under this Category can apply for citizenship of Australia after staying there for 4 years.

Once landed in Australia, the applicant can sponsor their family for permanent residency in Australia.

Dependents can accompany the applicant, provided they comply with the Australian Migration Law.

Eligibility for the Australia Skilled Immigration Program:

The applicants have to satisfy the basic requirements to migrate under the skilled sponsored visa and must meet the 65 points to file for a visa.

Age: Under 45 years of age at time of invitation.

English language: The applicant should prove that he/she meets the English language of competent level by submitting the test results before the application is lodged. He/ she should also meet the English Language threshold of minimum 6 bands of IELTS in all the components.

Nominated Occupations: The applicant should nominate an occupation on the Medium and Long term Strategic Skills List (MLTSSL) that matches with his/her skills, qualifications and work experience.

Skill Assessment: It is mandatory for an applicant to get a positive skill assessment for a nominated occupation before the visa application is lodged.

Skilled Nominated Visa (Subclass 190)

This is a Permanent Resident Visa which is an option to the individuals who cannot meet the Skilled Independent criteria and for those applicants whose occupation is not listed in the Medium and Long term Strategic Skills List (MLTSSL).

The basic requirement of this visa is to get sponsorship from a sponsoring State/ Territory in Australia. Applicants should also meet the points test by scoring 65. This visa is designed by the Australian government to address skill shortages in Australia.

The Skilled Sponsored Visa is only a Permanent Resident Visa and the applicants under this category must live for 2 years in Specified State from which he/she has been nominated.

Features of this Program:

The applicant has to be sponsored by State /Territory Government.

Skill Assessment: It is mandatory for an applicant to get a positive skill assessment for a nominated occupation before the application is lodged.

Maintenance funds: The applicants should show sufficient maintenance funds to obtain sponsorship from state territory.

Health & character requirements: The applicant has to meet with health and character requirements.

Skilled Work Regional (Provisional) Subclass 491 Visa

This is a provisional 5 years visa. It is for skilled workers who want to live and work in regional Australia.

This visa is for a member of the family unit of someone who holds a Skilled Work Regional (Provisional) visa (subclass 491)

The subclass 491 visa overruled the Skilled Regional (Provisional) subclass 489 visa from 16 November 2019.

Like the 489 visa, applicants for this visa must be nominated by an Australian state or territory government agency or sponsored by an eligible family member residing in a regional area and be invited to apply for the visa, following submission of an Expression of Interest (EOI) in SkillSelect.

Regional areas include everywhere except the metropolitan areas of; Sydney, Melbourne, Brisbane, Gold Coast and Perth.

The subclass 491 visa will be accessible for more people as over 500 new occupations are eligible to apply under this visa. Moreover, with an aim to meet the demand in regional Australia, 491 visa applicants will receive priority processing as well.

 Basic Eligibility

Point allocation for the 491 visa

There is a revised points system for the 491 visa so applicants have new ways to earn points towards their score. Applicants will get:

15 points = for nomination by a family member or a regional part of a state or territory, instead of 10 points under subclass 489 visa

10 points = for Masters or PhD level Australian qualification in certain Science, Technology, Engineering and Mathematics (STEM) qualifications; instead of 5 points under subclass 489 visa

Partner points

10 points = if one of the following applies:

Applicant has a skilled partner that means that the partner is under 45 years of age, obtains a positive skill assessment in a j ob on the same shortage list as the main applicant and has Competent English; or

Applicant is without a spouse or de facto partner (single); or

5 points = if applicant has a partner who can demonstrate Competent English but is not eligible for a positive skill assessment.

Points will still apply based on applicant’s age, qualification, years of overseas and/or Australian skilled work experience, Australian study and English skills, as they do under the 489 visa and other skilled visas.

You must submit an Expression of Interest (EOI) through SkillSelect and be nominated by a state or territory government or Austrade on behalf of the Australian government before being invited to apply for this visa.

 

The visa( Subclass 188) includes four streams:

 

Business Innovation stream: for people with business skills who want to establish, develop and manage a new or existing business in Australia. Applicants must be nominated by a state or territory government.

Investor stream: for people who want to make a designated investment of at least AUD1.5million in an Australian state or territory and maintain business and investment activity in Australia. Applicants must be nominated by a state or territory government.

Significant Investor stream: for people who are willing to invest at least AUD5million into complying significant investments in Australia and want to maintain business and investment activity in Australia. Applicants can be nominated by a state or territory government or Austrade on behalf of the Australian government.

Premium Investor stream: for people who are willing to invest at least AUD15million into complying premium investments in Australia and want to maintain business and investment activity in Australia. Applicants must be nominated by Austrade on behalf of the Australian government.

Holding this visa is the first stage before becoming eligible to qualify for a Business Innovation and Investment (Permanent) visa (subclass 888).

 

Business Innovation stream-Subclass 188

 

A genuine and realistic commitment to be involved as an owner of a new or existing business in Australia.

State or territory sponsored provisional visa with no minimum English requirement. .

Be less than 55 years of age

An overall successful business career.

Net business & Personal assets (Net-worth ) of $800,000.

A Business turnover of $500,000.

65 points required for Qualifying.

Queensland

In addition the DIBP criteria, if applicants seeking Queensland state nomination must meet the following criteria:

Preference will be given to investment in businesses in the agribusiness, tourism infrastructure, resources, infrastructure and education and training sectors, particularly in regional Queensland.

NSW Criteria

In addition the DIBP criteria, applicants seeking NSW state nomination must meet the following criteria:

 

You must demonstrate that you meet the Commonwealth Department of Immigration and Border Protection (DIBP) criteria for the Business Innovation & Investment visa by providing sufficient documentary evidence to prove eligibility.

You are aged less than 55 years at time of application.

If you are seeking to migrate to SYDNEY, your business must have an annual turnover (refer point 2 above) of at least $1.0 million.

If you are seeking to migrate to SYDNEY, you must have net personal and business assets (refer point 3 above) of at least $1.3 million.

You must provide a full resume of your business career and responsibilities demonstrating a successful business career.

 

You must provide a Business Commitment (see NSW Business Commitment template) for a profitable business in NSW demonstrating sound knowledge of the Australian market, providing details of research activities that you have undertaken and an evaluation on how your proposed business or investment will perform in the NSW context. The ownership share must be at least 51% with turnover of less than A$400,000 per annum, or 30% of a business with turnover of more than A$400,000 per annum, or 10% of a publicly-listed company.

 

Your Business Commitment must include at least $300,000 in business investment if your business will be in REGIONAL NSW. Your Business Commitment must include at least $500,000 in business investment if your business will be in SYDNEY. Your Business Commitment cannot be in one of the excluded industry sectors3 if your business will be in SYDNEY.

 

You must provide evidence of the availability of funds for settling and living expenses for not less than 1 year.

 

If DIBP have previously refused to grant you a business skills, business employment or Business Innovation & Investment visa, or has canceled such a visa, NSW may not sponsor you for a provisional visa unless you can show mitigating circumstances.

 

The ownership share must be at least 51% with turnover of less than A$400,000 per annum, or 30% of a business with turnover of more than A$400,000 per annum, or 10% of a publicly-listed company

Investment in business must be in either: property, plant & equipment; inventory, or; goodwill (if Purchased).

Excluded sectors include: Cafes & Restaurants (ANZSIC H4511); Takeaway Food Services (H4512); Supermarket & Grocery Retail Stores (G4110); Fruit & Vegetable Retailing (G4122); Specialized Food Retailing (G412); Newspaper & Book Retailing (G4244); Clothing Retailing (G4251); Footwear Retailing (G4252); Other Personal Accessory Retailing (G4259); Houseware Retailing (G4213); Manchester & Other Textile Goods Retailing (G4214); Other Electrical & Electronic Goods Retailing (G4229).

Victoria

In addition the DIBP criteria, if applicants seeking Victoria state nomination must meet the following criteria:

 

To be eligible for visa nomination by the state of Victoria, you will need to:

 

meet the DIBP eligibility requirements for this visa; and

have a genuine commitment to remain in Victoria and to engage in ongoing eligible business activity within 23 months of visa activation; and

agree to transfer no less than A$600,000 net assets (of which A$400,000 will be available for business) to Victoria within 23 months of visa activation.

PERMANENT RESIDENCY VISA

Business Talent (Permanent) (subclass 132) visa

There are two streams under visa subclass 132:

DIBP Requirements

You might be able to get this visa if you are nominated by a state or territory government agency and are invited to apply by the minister.

 

You must also either:

 

have net business and personal assets of at least AUD1.5 million and an annual business turnover of at least AUD3 million if you intend to apply for the visa in the Significant Business History stream, or

have obtained at least AUD1 million in venture capital funding to start the commercialization and development of a high-value business idea in Australia if you intend to apply for the visa in the Venture Capital Entrepreneur stream.

Note: New South Wales (NSW) is now closed to applications for nomination under the Business Innovation and Investment Program (BIIP).

 

NSW has exhausted its allocation of nomination applications this program year.

 

NSW is unable to accept emailed applications for the BIIP until the new program year commences 1st July 2020. This includes the:

Working Rights

 

Student visa holders can work for a maximum of 40 hours per fortnight when their course is in session, and once the course has commenced.

 

A fortnight means 14 days starting on a Monday.

 

If you are under 18, you must prove you have either:

 

Nominate a student guardian

Nominate a parent, legal custodian or relative over 21 years of age as your student guardian. This person must have a visa to stay in Australia for the duration of your student visa or until you turn 18.

FAMILY VISA -

The Australian Family migration stream intends to reunite immediate and extended family members with their eligible Australian relatives.

Family Spouse Visa

A Family Spouse Visa allows a married partner (opposite or same-sex) to join his/her spouse in Australia. The sponsor should be Australian citizen or permanent residents or eligible New Zealand citizens. This temporary visa is issues for 2 years, after which, the relationship is re-examined. If it is considered as genuine then the applicant is issued a permanent visa. Upon approval, the applicant is permitted to live, study and work in Australia.

 

Prospective Marriage Visa

Applying for an Australian Prospective Marriage visa allows applicant to visit Australia to marry their fiance(e), Australian citizens, permanent residents or eligible New Zealand citizens.

 

This is a temporary visa, valid for 9 months. Visa holders should intend to marry their fiance(e) within 9 months. Post marriage, applicant can apply for an Australian Spouse visa if they wish to remain in Australia permanently with their spouse.

 

Aged Parent Visa

An Aged Parent visa permits retirement aged parents to join their children living in Australia, permanently. The applicant should have been living in Australia on a valid temporary visa. The sponsor (read children) should be eligible Australian or New Zealand residents settled in Australia. Male applicants should be at least 65 years of age, while female applicants should be at least 63 years of age. Once approved, they are allowed to live, study and work in Australia,

 

Parent Visa

A very popular migrant visa, Parent Visa enables parent to join their children in Australia permanently. The child should be eligible sponsor for the parents. However, it is important that applicants should have at least half of their children living legally and permanently in Australia. Upon approval, the applicant is entitled to live, study and work in Australia, permanently.
